Advance Notice of Proposed Rulemaking, Contract Closeout, 67 FR 59799, September 24, 2002.
SUMMARY: The Civilian Agency Acquisition Council and the Defense
Acquisition Regulations Council are requesting comments from both
Government and industry on how the Federal Acquisition Regulation
(FAR), Defense FAR Supplement (DFARS), and General Services
Administration Acquisition Regulation (GSAR) can be revised to
facilitate timely contract closeout.

SUMMARY: The Civilian Agency Acquisition Council and the Defense
Acquisition Regulations Council (Councils) are proposing to amend the
Federal Acquisition Regulation (FAR) by revising three cost principles:
(1) Economic planning costs; (2) Employee morale, health, welfare, food
service, and dormitory costs and credits; and (3) Travel costs. The
changes are to increase clarity and readability.

SUMMARY: The Civilian Agency Acquisition Council and the Defense
Acquisition Regulations Council (Councils) are proposing to amend the
Federal Acquisition Regulation (FAR) to revise the ``selling costs''
cost principle to increase clarity and to remove excessive wording and
details.

notify the contracting officer if the Government overpays the
contractor when making an invoice payment or a contract financing
payment under both commercial item and non-commercial item contracts.

SUMMARY: The Civilian Agency Acquisition Council and the Defense
Acquisition Regulations Council (Councils) are considering whether
there is a need at this time for changes to the Federal Acquisition
Regulation or other acquisition guidance to promote more consistent and
effective implementation of Section 508 of the Rehabilitation Act of
1973 and, if so, what specific changes are needed. The Councils request
that interested parties provide comments.

SUMMARY: The Civilian Agency Acquisition Council Chairman and the
Defense Acquisition Regulations Council Chairman (Councils) have agreed
to withdraw Federal Acquisition Regulation (FAR) case 2000-401,
Definitions of "Applied Research" and "Development," which was
published in the Federal Register at 65 FR 54940, September 11, 2000.
No public comments were received on the case. The proposed rule
combined and moved the two separate definitions of "Applied research"
and "Development" into the definitions area of the FAR.
FAR Case 2000-016, Federal, State, and Local Taxes, 67 FR 38551, June 4, 2002.
SUMMARY: The Civilian Agency Acquisition Council and the Defense
Acquisition Regulations Council (Councils) are proposing to amend the
Federal Acquisition Regulation (FAR) to clarify the prescriptions for
use of clauses relating to Federal, State, and local taxes. In
addition, the rule deletes the clause regarding taxes-contracts
performed in U.S. possessions or Puerto Rico, and updates and moves the
definitions of “local taxes”.

FAC 2001-05, Stay of Certain Labor Relations Provisions, 67 FR 5027, March 7, 2002.
SUMMARY: The Civilian Agency Acquisition Council and the Defense
Acquisition Regulations Council (Councils) published an interim rule in
the Federal Register at 66 FR 27414, May 16, 2001, implementing
Executive Order 13202, Preservation of Open Competition and Government
Neutrality Towards Government Contractors' Labor Relations on Federal
and Federally Funded Construction Projects, which prohibits including
requirements for affiliation with a labor organization as a condition
for award of any contract or subcontract for construction or
construction management services. Executive Order 13202, as amended, is
currently the subject of litigation in the Federal courts, and an
appeal is pending in the United States Court of Appeals for the
District of Columbia Circuit. Pending resolution of this litigation,
the Councils are now issuing a stay of a paragraph of the rule. After
final judicial resolution of the dispute, the Councils will, as
appropriate, issue a notice regarding the status of the rule. The
Councils request comments on this action.

the interim rule published in the Federal Register at 66 FR 27414, May
16, 2001, is stayed indefinitely.

FAR Case 2000-302-Correction, Veterans Entrepreneurship and

SUMMARY: The Civilian Agency Acquisition Council and the Defense
Acquisition Regulations Council are issuing amendments to FAC 2001-01,
FAR Case 2000-302, Veterans Entrepreneurship and Small Business
Development Act of 1999 published in the Federal Register at 66 FR
53492, October 22, 2001, to correct the language concerning the
separate goal for service-disabled veteran-owned small business
concerns. Language was added in FAC 97-20 that service-disabled
veteran-owned small business concerns were to be included in the goal
for veteran-owned small businesses. This was based on a statutory
change. A further statutory change established a goal for service-
disabled veteran-owned small business concerns that is separate from
the goal for veteran-owned small business concerns. This statute was
implemented in FAC 2001-01 but, inadvertently, some of the FAC 97-20
language intended for deletion did not appear in the published case.

FR 17758, April 3, 2001, a proposed rule with request for public
comments revoking the December 20, 2000, final rule. The proposed rule
specified a June 4, 2001, due date for receipt of comments. The FAR
Council has decided to extend that due date until July 6, 2001, to
ensure all potential commentors have adequate time to prepare their
submissions. Also, to ensure an open dialogue between the Government and
interested parties on the proposed rule, the FAR Council will hold a
public meeting on the proposed rule on June 18, 2001.

other proceedings. After further review, the FAR Council is immediately
staying that rule. The FAR Council intends the stay will last for 270
days from April 3, 2001, or until finalization of the proposed rule
(entitled "Contractor Responsibility, Labor Relations Cost, and Costs
Relating to Legal and Other Proceedings" that is being published
concurrently with this interim rule), whichever is sooner. The FAR
Council is requesting comments in this FAR interim rule on the length of
the stay. During the stay, the FAR text is restored to the text as it
existed before January 19, 2001. In a separate document being published
today, the FAR Council is publishing a proposed rule, requesting
comments under that FAR case on revoking the December 20, 2000, final
rule.
DATES: Effective Date: Effective April 3,
2001, the rule published in the Federal Register at 65 FR 80255,
December 20, 2000, is stayed indefinitely (except for the redesignation
of 9.104-3(c) and (d) as 9.104-3(d) and (e); the designation of the text
in 31.205-21 as paragraph (a); and the redesignation of 52.209-
5(a)(1)(ii) as 52.209-5(a)(i)(iii)). The amendments made by this rule
are effective April 3, 2001.
Applicability Date: The FAR,
as amended by this rule, is applicable to solicitations issued on or
after January 19, 2001. Contracting officers must amend solicitations
already issued that incorporated the certification provision(s) from the
final rule published in the Federal Register on December 20, 2000 (65 FR
80255), to delete those certification provision(s) and insert the
certification provision(s) in this rule.

FAC 97-22 Delay of
Effective Date 66 FR 14259, March 9, 2001. SUMMARY: In
accordance with the memorandum of January 20, 2001, from the Assistant
to the President and Chief of Staff, entitled "Regulatory Review Plan,"
published in the Federal Register on January 24, 2001, this action
delays for 60 days the effective date of Items I, III, IV, and V of
Federal Acquisition Circular (FAC) 97-22 published in the Federal
Register on January 10, 2001 (66 FR 2116). The 60-day delay in the
effective date is necessary to give agency officials the opportunity for
further review and consideration of new regulations, consistent with the
